RERA & Property Buyer Protections in 2026: What Every Buyer Must Know

20 June 2026SVI Legal Desk
RERA & Property Buyer Protections in 2026: What Every Buyer Must Know

Comprehensive guide to how RERA safeguards property buyers, ensures timely project delivery, and regulates Indian real estate.

!Key Takeaways

  • 1RERA mandates that 70% of buyer funds be kept in a dedicated escrow account for construction
  • 2Developers must pay interest for construction delays at standard state RERA rates
  • 3Always cross-check the project RERA registration number on the official state portal before paying booking amounts

The Real Estate (Regulation and Development) Act (RERA) has fundamentally transformed the Indian real estate ecosystem. Designed to protect homebuyers from project delays, false promises, and financial irregularities, RERA ensures transparency and accountability at every stage of real estate transactions.

1. Mandatory Project Registration & Escrow Accounts

Under RERA, developers cannot advertise or sell any residential or commercial property without registering the project with the state RERA authority. Key safeguards include:

  • 70% Escrow Rule: Developers must deposit 70% of funds collected from buyers into a dedicated project escrow account, usable only for land acquisition and construction.
  • Clear Project Disclosure: Floor plans, sanction layouts, completion timelines, and legal approvals must be published on the RERA portal.
  • Standardized Sales Agreement: Eliminates one-sided clauses that previously favored developers.

2. Strict Penalties for Project Delays

One of RERA's strongest buyer protection mechanisms is its penalty structure for delayed possession:

  • If a developer fails to hand over property by the specified date, they must pay monthly interest to the buyer at state-prescribed rates.
  • Buyers have the right to withdraw from the project and request a 100% refund with interest if delivery timelines are breached.

3. Carpet Area Standardization

Before RERA, builders used ambiguous terms like "super built-up area" to charge buyers. RERA mandates pricing based strictly on Carpet Area — the net usable floor area inside the apartment walls.

4. 5-Year Structural Defect Guarantee

Developers are legally bound to fix any structural defects or workmanship flaws within 5 years of handing over possession, without charging the homeowner any extra cost.

Conclusion

RERA has brought peace of mind to Indian property buyers. Always verify your builder's RERA registration number on the official state portal before making any financial commitment.
